Triple talaq bill cleared.Reuters

The Union Cabinet cleared the Triple Talaq Bill on the first day of the Winter Session of Parliament on Friday.

The government had decided to introduce legislation to end the practice of instant triple talaq after the Supreme Court struck down the practice.

The top court had declared the practice of a Muslim man divorcing his wife by uttering the word "talaq" thrice as "unconstitutional" and suspended it for six months on August 22.

The clearance which itself is an achievement will now be taken up for debate in the Winter Session of Parliament. If majoirity of the Parliament will support the SC's ruling, followed by the approval of the President, then instant triple talaq will be declared a crime by law.

It will also be a non-bailable offence.

The controversial issue had earlier enjoyed a 3-2 majority in the five-Judge bench of the SC, comprising Chief Justice of India JS Khehar, Justices Kurian Joseph, Rohinton Fali Nariman, Uday Umesh Lalit and Abdul Nazeer.

While While Justices Nariman, Lalit and Joseph were in favour of doing away with instant triple talaq, CJI Khehar and Justice Nazeer had disagreed with them.
